These booking terms and conditions, including any revised booking terms and conditions that we may post from time to time, state the terms and conditions under which Bab Al Nojoum Camp L.L.C. - S.P.C (“Bab Al Nojoum”, “Resort”, we”, “us”, “our”) will provide Resort accommodation to the guest. Please read these terms and conditions carefully.
1. Definitions
1.1 Unless otherwise requires, any capitalized terms used in these terms and conditions have the following meanings:
“Accommodation” means guests requested stay in the Resort.
“Booking” means a reservation made by the guest for accommodation at Bab Al Nojoum, whether made via our online reservation system or otherwise.
“Charges” has the meaning given to it in clause 4.2.
“Force Majeure” means an unforeseeable, unavoidable event beyond a party`s reasonable control, including fire, storm, earthquake, tsunami, flood, hurricane or other act of God, explosion, casualty, strike, unavoidable accident, riot, insurrection, civil disturbance, act of public enemy, act of terrorism, embargo, war, inability to obtain labor, materials or supplies, economic downturn, social or political factors, any outbreak of disease, epidemics, quarantine restrictions, public health restrictions, any governmental regulation, disruption to local, national or international transport services, restriction or prohibition or any other similar cause. “Bab Al Nojoum” means the Bab Al Nojoum Camp LLC that is the subject of guests’ Booking.
“Terms and Conditions” means these booking terms and conditions, as may be amended by us from time to time.
2. Bookings
2.1 The customer using the website who are minor /under the age of 18 shall not register as a user of the website and shall not transact on or use the website.
2.2 Guests may make a Booking by using our online reservation system, or via other channels e.g. our call centres and travel agents. Accommodations are subject to availability and any applicable taxes as advised during booking process.
2.3 In accordance with the rules and regulations of the United Arab Emirates, all guests have to be registered, with valid proof of identification provided (passport or national ID) at the time of check in. External visitors of the guests will be required to present their valid proof of identification.
2.4 Guest do not acquire the right to the availability of a specific tent. Bab Al Nojoum reserves the right to substitute guests Booking for a similar or a better tent category at the Resort, if the tent category specified in guest’s Booking is unavailable.
2.5 Bab Al Nojoum may cancel guests Booking at any time, without prejudice to any other right it may have due to any operational reason or event of Force Majeure.
2.6 “(Website) will NOT guarantee for any bookings made by third party websites.
2.7 “(Website) will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE”.
3. Check-in and Check-out Times
3.1 Bab Al Nojoum’s standard check-in time is 15:00 hrs, subject to availability and check-out time is 12:00 hrs midday.
.2 Additional charges may apply in case check-out time is extended subject to Resort pre-approval and availability.
3.3 In case of unexpected early departure, the Resort reserve the right to charge as per cancellation policy mentioned in Booking.
4. Payment
4.1 The charges of the stay will be paid in full upon check-in and an additional fixed amount to cover potential incidentals as per the Resort policy in the form of a cash deposit or credit card pre-authorization.
4.2 Charges, including outstanding Accommodation charges, if any, and any other charges, such as room service, mini-bar and any meals charged to tent (“Charges”) are payable on presentation of an invoice for such Charges (Euro cheques are not accepted).
4.3 “We accept payments using Visa, MasterCard, American Express, Diners credit/debit card in AED”.
4.4 Foreign currency cannot be taken as a cash deposit unless exchanged into the local currency at the existing Resort rates and the balance returned in local currency.
4.6 For credit card payment, pre-authorization will be taken upon arrival and once the outstanding Charges exceed the pre-authorization, the exceeding amount will be taken accordingly without prior notification.
4.7 All additional charges have to be settled upon check-out. The Resort has the right to charge the guest credit card after check-out without any notification, in case any due amount not been settled at the time of check-out or any damages found from misuse of the Resort facilities.
4.8 “All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties”.
4.9 In case the guest is having more than one transaction and paying separately, there is a chance that multiple transactions will reflect on the credit card holder’s monthly statement of account.
4.10 The Resort resort requires credit card details in order to guarantee the reservation.
4.11 The Resort resort reserves the right to pre-authorize your credit card upon booking.
4.12 Non-guaranteed reservations will automatically be cancelled without Resort resort`s notice.
4.13 Upon check in, guest must present the same credit card used at the time of booking. If the credit card presented at the time of check in is different than the one used to make the booking, the new credit card will be used for the payment and the previous pre-authorization will be released as per the bank regulations.
4.14 The charges of the stay will be paid in full upon check-in and an additional fixed amount to cover potential incidents as per the Resort policy mentioned below in the form of a cash deposit or credit card pre-authorization.
4.15 Minimum of 50% of the charges for one night per tent
5. Taxes (VAT)
All Bookings & Resort paid services will be subject to VAT as applicable and in accordance with the existing legislation or any legislation that may be introduced in the future.
6. Cancellation/amendments/no-show
6.1 Booking Cancellations, amendments to Booking and/or no-shows may be charged in accordance with the applicable Bab Al Nojoum policy and as advised during Booking process.
6.2 Guest acknowledge and agree that, if applicable, we may charge the fee for the cancellation or amendment of Booking and/or no-show to guest credit card.
6.3 In case of any refund required, will be done through the original mode of payment.
6.4 “Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE”.
6.5 Non refundable - The rate is available only on non-refundable basis.
Full prepayment is required for this special rate. Upon booking entire stay amount will be charged to your credit card(full prepayment). The reservation is non changeable and, in case of cancellation, modification or non-show the prepayment is non refundable.
6.6 This is a last minute booking. You can cancel only by contacting the hotel.
7. Right of Refusal
Resort reserve the right to refuse any outside visitors, entry to the Resort and cancel Accommodation if, on arrival, we consider that the visitors, are under the influence of alcohol or drugs, are unsuitably dressed or are behaving in a threatening, abusive or otherwise unacceptable manner.
8. Behavior
8.1 Resort reserves the right to require guest or outside visitors to immediately vacate the tent, check-out and leave the Resort premises if the behavior is threatening, abusive, annoying or otherwise unacceptable manner which could trigger (or has triggered) a risk to the safety and health of other guests or staff of the Resort or are causing (or have caused) a disturbance or annoyance to other Resort guests or staff.
8.2 Guest must comply, and must ensure that all outside visitors comply, with all reasonable rules and procedures in effect at the Resort and notified to the, including but not limited to health and safety, security procedures and any other UAE Law.
8.3 Under no circumstances the guest may take photographs of the Resort premises or its other guests privacy to sell or for any other commercial / abusive purposes.
8.4 Neither the guest nor any of outside visitors will be allowed to arrange external served ready food & beverage delivery to the Resort.
8.5 Guests may not, and must ensure that any of the external visitors do not, enter areas of the Resort which are indicated as being closed to the public.
8.6 Please be advised that smoking is not permitted inside the tents and public areas of the Resort, except in expressly designated smoking areas.
8.7 All type of pets are not allowed within the premises of Bab Al Nojoum.
8.8 Children under the age of 12 must be supervised by an adult at all times.
9. Property damage/loss
The guest will be responsible to remedy any loss or damage caused to Resort property, furnishings, fittings or equipment (including, without limitation, towels, linen and other items in the tent).
10. Pools, Beach, Water-activities
Please be advised that there is no lifeguard available at the private pools part of glamping tents. Usage of beach facilities after duty hours of lifeguards is at guests’ own risk without any liability on the Resort.
11. Valuables
11.1 Free safety box are available in reception area for guest usage, to keep money, jewellery and other valuables items. Keeping any of these items in the tents or Resort premises, will be at guests’ own risk and the Resort and its staff will not be liable for any loss, missing or damage of these items.
12. Visitors
Additional occupancy charges in case of outside visitors to the tent, will apply in accordance with applicable rates.
13. General
13.1 Bab Al Nojoum will not be liable to the guest or any of his external visitors, for any loss or damage to property caused by the misconduct or negligence of another guest.
13.2 Bab Al Nojoum will not be liable to any guest for any failure or delay in performing any of our obligations if the failure or delay was due to an event of Force Majeure.
13.3 If any provision of these Terms and Conditions is deemed unlawful, void or for any other reason unenforceable, then that provision shall be deemed severed from the Terms and Conditions and shall not affect the validity and enforceability of any other provisions.
13.4 Resort`s failure to exercise or enforce any rights or provisions of the Terms and Conditions will not constitute a waiver of such rights or provisions.
13.5 Nothing in these Terms and Conditions shall create a contractual relationship with, or cause of action in favor of, any third party. Any rights of any third party to enforce these Terms and Conditions under any applicable legal principle, statute or otherwise are excluded.
13.6 “The Website Policies and Terms and Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, the guests are encouraged to frequently visit these sections in order to be updated about the changes on the website. Modifications will be effective on the day they are posted”.
